TERMS AND CONDITIONS

We're delighted to welcome your child to Cook Stars and hope they have a fantastic time cooking with us!

These terms and conditions (Terms) are between the franchisee operating the Cook Stars franchise at the location selected by you (we, us or our) and you, the person booking or receiving the Services (you or your). You accept these Terms by making a booking or payment with us. We agree to provide the Services to you pursuant to these terms and conditions. The Services are those chosen by you as set out on our website or in our online booking form, which will be the applicable cookery sessions/workshops or party booking.

Please take note of the following:

Classroom Sessions:

All children attending our Mini's class and Junior's class are able to enjoy their first 2 taster classes for the price of one (Buy One Get One Free Taster Session)! We think that your child will fall in love with Cook Stars after one session, but having 2 no obligation classes for the price of one means, they have more time to settle in and cook different recipes before committing. The Buy One Get One Free Taster Session is only available for your first 2 taster classes and cannot be claimed if you have previously booked a session at any Cook Stars location.

Registration:

All parents/carers must answer all questions in full and agree to the terms and conditions before a child can be accepted at the cookery sessions/workshops. Any changes to the information contained on the registration form, whether it be contact details, medical details, change of address, etc., must be notified in writing by the parent/carer as soon as possible to the class leader.

Cooking Session Bookings:

The prices and payment options for our sessions will be set out on our booking page when you book.

When booking your Buy One Get One Free Taster Sessions online, simply select classes for 2 consecutive weeks and the reduction will automatically be applied at checkout!

There is no obligation to join for the remainder of classes. Should you wish to join in for the remainder of the half term, you will be invoiced accordingly.

Other than the Buy One Get One Free Taster Session, parents agree to book and pay for sessions half termly IN ADVANCE. For returning customers, payment is required during the half term to secure a place for the following half term.

When you use the pay monthly plan, automatic payments may still be paid during school holidays, even if there are no sessions running. This is due to payments being spread out over the full 12 months to give you low monthly payments.

If you don’t pay on time as agreed, we can choose to stop providing the Services 5 business days after the payment was due. We can also ask you to pay for any extra costs we face because you didn’t pay on time (including interest). This includes any costs to recover those payments from you. Any costs incurred by Cook Stars relating to the recovery of fees will be added to any amount outstanding.

You must notify us asap if your child no longer requires a place at our sessions to allow opportunity for another child to join.

Please ensure that a minimum of 1 weeks’ notice is given to change pre-booked arrangements.

It is not possible to offer refunds due to non-attendance at a class once a booking has been made. If your child cannot attend their usual session, we will look to accommodate them at a different session (if we have space). If this is not possible, or you cannot attend the sessions offered, the fee for that class is non-refundable.

Party Bookings:

A deposit of £50 is required to secure a party booking. Please send us the party booking form along with the payment of the deposit and we will send confirmation once we have received payment. You may pay us directly to our nominated bank account. Your party invitations will be sent shortly after.
You will be notified of the remaining balance for the party booking 1 week before your party when final numbers are confirmed and finalised. The remaining balance is payable 1 week prior to the party. Please note – it is not possible to refund any monies for non-attendance (for example if someone does not come along to the party).

If on the day of the party, additional children attend the party beyond the final numbers that we confirm with you, we will only accommodation the additional child/children if we have the capacity to do so and we have received the appropriate documentation and forms relating to food allergies, food intolerances and dietary restrictions. You agree that you will be responsible for paying the relevant fee for any additional child that attends the party beyond the finalised confirmed numbers.

Pick-up of Children:

Children must be collected on time. If a child is collected late, parents will be invoiced for the extra staffing costs.

No child is to be dropped off before the start of the session. Our staff cannot take responsibility for children who arrive at a session earlier than the session start time and parents will be invoiced for the extra staffing costs.

Please advise us in advance if someone other than you or your child's usual carer is collecting your child from our class. Please arrange a password with your class leader so we can ensure safe collection.

Children must be collected from the class leader at the classroom. Children will not be released from a session without a guardian to collect them.

Behaviour:

All children are expected to behave appropriately at our sessions. We ask parents to encourage children to support this rule.

Parents will be informed if their child's behaviour is inappropriate. We ask that you help us to set the right example to the children by treating our colleagues with the respect they deserve whilst at work. If your child's behaviour is deemed dangerous or poses health and safety risks during a session, we will notify you and they may be asked not to attend in the future.

Please ensure we are made aware of any behavioural needs of your child.

Child Welfare:

In the event of an emergency, parents consent to us seeking any necessary emergency medical advice or treatment during the running of the cookery session.

Children under 5 years old require an adult to accompany them and must not be left alone during the session.

It is your responsibility to ensure we are made aware of any dietary requirements or restrictions your child may have. You will be asked about this during the booking process and if you have stated your child has an allergy or intolerance you will be asked to complete a separate form regarding this so we can assess if our classes are suitable for your child.

For party bookings, it is also important that you let us know in advance of the party of any children who have food allergies, food intolerances or special dietary requirements. We ask that you seek confirmation from all parents of any dietary restrictions. You will be responsible for providing us with all information relating to food allergies, food intolerances or special dietary requirements in relation to all party guests and attendees. You will be sent a form for completion along with your invites for all such guests. We may ask for more information about this to ensure the safety of our party guests and may require written consent from parents.

Any child who has suffered from diarrhoea, sickness, or conjunctivitis is not permitted to attend our sessions for a period of at least 48 hours after such condition has ceased.

Unless stated in the allergies section on the form, you give permission for Cook Stars staff to use antiseptic wipes and/or plasters on your child should they be needed.

Children are not permitted to taste foods that contain raw eggs or raw meat used in preparation during class.

Our classes are designed to be age appropriate however some preparation methods could be harmful (eg. grating). We will advise on the safest way to use equipment but ultimately the decision of whether you want your child to use specific equipment is up to you. Please notify us if you have any preferences regarding the use of preparation equipment.

Please note, all ingredients, equipment and aprons are included so you do not need to bring anything along. We ask that children do not bring any electronic devices or other distractions to our classes.

ONLINE SESSIONS:

By signing your child up to our online cookery sessions, you are accepting full parental responsibility for all children who attend. An adult guardian is required to supervise children at ALL times. Our sessions are not suitable for children under 2 years old and are not intended for children to do entirely independently.

Children should NOT use any electrical equipment, hobs and ovens alone parents need to do this. Parents must assure the area their children/ you will be working in is clean and clear from any hazards.

Children must wash their hands for at least 20 seconds before joining the sessions.

An apron is recommended to ensure clothes do not get damaged.

For children who have allergies, we advise checking the labels on all ingredients to ensure they are suitable for your child.

We accept no responsibility for ensuring our recipes are suitable for children with allergies/intolerance, this is the parent’s full responsibility.

Termination:

These Terms may be terminated by either party (the Non-Defaulting Party), with immediate effect, if the other party (the Defaulting Party) fails to fulfil an obligation under these Terms and the Defaulting Party does not correct the breach within 10 business days after receiving written notice from the Non-Defaulting Party.

Suspension:

We may suspend the provision of Services to you: (a) if we reasonably suspect you are in breach of these Terms; and while we investigate the suspected breach. If, following our investigation, we reasonably believe you are in breach of these Terms, we may terminate these Terms immediately, without penalty, by written notice to you.

Cancellations:

You do not have a right to cancel the Services under the consumer law because the Services fall under an exception to that right, being the supply of catering or services related to leisure activities, for a specific date or period of performance.

Consumer law:

Under the Consumer Rights Act 2015 and other applicable UK consumer protection laws, certain statutory rights apply to the supply of goods and services. In summary, these rights mean that we are required to ensure that the Services: (a) are performed with reasonable care and skill; (b) are as we describe them to you; and (c) are carried out within a reasonable time and for a reasonable price, if we have not agreed the time and price with you.

Nothing in these Terms is intended to affect or limit your rights as a consumer.

Liabilities:

We accept children to our sessions on the assumption that they are in good health. It is the responsibility of the child’s guardian to alert us to any medical complaint or history of illness suffered by your child.

We do not accept responsibility for medically diagnosing individuals, or for the medical management of attendees at our sessions at any time. Additional professional advice from qualified medical practitioners should be sought by those experiencing symptoms.

We do not accept loss or damage arising from errors or omissions on the registration form whether completed by you or by another person in charge of your child at the time of completion.

Subject to the any limitations (as described below under “Limitations”), we do not accept liability for infection or illness derived from attendance at our sessions.

Allergies:

You are responsible for providing us with the relevant forms in relation to your child’s food allergies, food intolerances or special dietary requirements and adequately informing us of your child’s food allergies, food intolerances, or special dietary requirements.

For party bookings, you are responsible for providing us with the relevant forms in relation to all attendees’ food allergies, food intolerances or special dietary restrictions and adequately informing us of all attendees’ food allergies, food intolerances or special dietary requirements.

You must ensure that if your child, or any relevant attendee of a party, requires an EpiPen, such child or attendee must be accompanied by their parent or guardian, unless the relevant parent or guardian provides express written consent for the child’s or attendee’s participation in a session without their parent or guardian, whereby such participation means the child or attendee will not be accompanied by an adult who is medically trained to administer an EpiPen.

Subject to any limitations (as described below under ‘Limitations’), we are not responsible for any allergic reactions or medical incidents that may arise as a result of your failure to comply with your obligations under this clause. You shall indemnify and hold us, our officers, employees, and agents harmless against all claims, demands, actions, costs, expenses (including legal costs on a full indemnity basis), losses, damages and liabilities whatsoever arising from or in connection with a breach of your obligations under this clause; any inaccuracy, incompleteness or misrepresentation in the information or documentation collected or transmitted by you; and your failure to collect or transmit any information or documentation required by us, including but not limited to, the requested forms relating to food allergies, food intolerances or special dietary restrictions for your child or all attendees of a party booking. This indemnity shall survive termination of this agreement.

Other Losses:

We do not accept responsibility for any loss or expense due to circumstances beyond our control, including, but not limited to, delays in public transport, weather, quarantine, sickness, bereavement, strikes or other industrial action, terrorism, fire and riot.

Limitations:

We will perform the Services with reasonable care and skill. However, we are not liable for any indirect or consequential losses that may arise. Subject to your consumer law rights and the following sentence, our total liability under these Terms is limited to the price paid or payable by you for the Services. We do not exclude or limit in any way our liability to you where it would be unlawful to do so, which includes liability for fraud or fraudulent misrepresentation, and death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors.

Dispute Resolution:

In the event of a dispute, the parties will first attempt to resolve the matter through mutual discussion or mediation.

Governing Law:

These Terms are governed by the laws of England and Wales. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in England and Wales and any courts entitled to hear appeals from those courts and waives any right to object to proceedings being brought in those courts.
No third party rights: Nothing in these Terms confers or is intended to confer any right to enforce any of its terms on any person who is not a party to them.

Privacy:

We are a franchisee under the Cook Stars franchise network. We may collect personal data from you as joint controllers with our franchisor, Cook Stars Ltd.
We act as joint controllers when collecting identity and contact details, service-related information, financial and payment information, digital information, and special category data. We will comply with all applicable data protection laws with respect to the transfer or processing of any personal data in connection with these Terms. We handle your personal data in accordance with our privacy policy, available on our website and our franchisor will handle you personal data in accordance with the franchisor’s privacy policy here.

Subcontracting:

We reserve the right to subcontract any portion of the Services at our discretion without needing to get your written approval beforehand. We commit to being fully responsible for fulfilling our obligations under these Terms, and we will ensure that any subcontractors we employ will adhere to the terms of these Terms as if we were performing the Services directly.
